Terms and conditions
1. Information on how to enter and prizes form part of these terms and conditions. Submission of an entry (as defined below) is deemed acceptance of these terms and conditions.
2. Entry is only open to Australian residents (“Entrant”). If an Entrant is under the age of 18 they must obtain prior consent from their parent or legal guardian to enter and the parent or legal guardian may be required to verify the granting of consent and/or sign a release at the discretion of the Promoter. Failure of an Entrant’s parent or legal guardian to verify consent and/or sign a release under this clause will invalidate the Entrant’s entry.
3. Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter.
4. Promotion commences on 0.00am AEST 30 September 2014 and entries close at 4.00pm AEDT on 31 October 2014 (“Promotion Period”).
5. To enter, individuals must, during the Promotion Period:
a) obtain the Promotional entry form from Narrabri Courier (“Entry Form”);
b) correctly answer all questions contained on the Entry Form and input all mandatory requested personal information; and
c) either:
(i) mail the completed Entry Form to Santos Narrabri at PO Box 859, Narrabri NSW 2390 (“Santos Shopfront”) so that the completed Entry Form is received during the Promotion Period; or
(ii) drop off the completed Entry Form to a staff member at the Santos Narrabri Shopfront at 125 Maitland Street, Narrabri NSW 2390 (“Santos Shopfront”).

6. The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants (including an Entrant’s identity and place of residence) and to disqualify any Entrant who submits an Entry that is not in accordance with these terms and conditions or who tampers with the Entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
7. Incomplete, illegible or indecipherable Entries will be deemed invalid. Any incorrect details submitted may render the corresponding Entry invalid.
8. Maximum three Entries permitted per person.
9. If there is a dispute as to the identity of an Entrant, the Promoters reserve the right, in their sole discretion, to determine the identity of the Entrant.
10. The draw will take place at Santos Shopfront on 31 October 2014 at 4.30pm AEDT.
11. For the avoidance of doubt, only Entrants who have correctly answered the questions on the Entry Form are eligible to win a prize. The first (1) valid and correct Entry drawn will win a 128GB iPad valued at $1,049.00 (“Major Prize”). The next five (5) valid and correct entries drawn will each win $50.00 movie voucher from The Crossing Theatre, 117 Tibbereena Street, Narrabri NSW 2390 (“Runner Up Prizes”).
12. Total prize pool value is AUD$1,299.00.
13. Winners will be notified by telephone and by email on 31 October 2014 and the names of all winners will be published in the Narrabri Courier on 4 November 2014.
14. The Promoter’s decision is final in relation to all matters in this Promotion and no correspondence will be entered into.
15. All prizes, or any unused portion of a prize, are not transferable or exchangeable and are not redeemable for cash.
16. Subject to the unclaimed prize draw clause, if for any reason whatsoever a prize winner does not take a prize by the time stipulated by the Promoter then the prize will be forfeited by the prize winner and cash will not be awarded in lieu.
17. If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with an alternative prize to the equal value and/or specification, unless to do so would be prohibited by law and subject to any written directions from a regulatory authority.
18. If for any reason whatsoever beyond the reasonable control of the Promoter, the Promotion is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) disqualify any Entrant; and/or (b) subject to any written directions from a regulatory authority, to cancel, suspend, modify, terminate or cancel the Promotion.
19. Unless expressly stated within these terms and conditions regarding all prizes, all other expenses become the responsibility of the winner, including any costs in excess of the (GST inclusive) value of the Runner Up Prize.
20. The Promoter shall not be liable for any Runner Up Prize that has been lost, stolen, forged, damaged or tampered with in any way.
21. Redemption of the Runner Up Prize is subject to any terms and conditions specified on the Runner Up Prize and to the Runner Up Prize issuer’s standard terms and conditions.
22. The laws of New South Wales apply to this Promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of New South Wales.
23. If required, an unclaimed prize draw may take place on 2 February 2015 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners names will be published in the Narrabri Courier on 9 February 2015.
24. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these terms and conditions would contravene any statute or cause any part of these terms and conditions to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, the Promoter excludes from these terms and conditions all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non-Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise, for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax implications; (e) any variation in reward value to that stated in these terms and conditions; (f) any tax liability incurred by a successful claimant or Entrant and/or (g) a prize or use of a prize.
25. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and for any purpose required under Australian lottery legislation or any other regulatory authority. Recipients of Entrants’ personal information may be located in Australia]. Entry is conditional on providing this information. Unless otherwise advised at the time of entry, the Promoter may also use the information for promotional, marketing and publicity purposes. Entrants should direct any request to access, update or correct information to the Promoter. The Promoter’s privacy policy contains information about how an Eligible Entrant may access or correct personal information held about them or complain about a breach of the Australian Privacy Principles. All entries become the property of the Promoter.
